By accessing, registering for, purchasing, subscribing to or otherwise using any LBG Software service, you agree to be bound by these Terms and Conditions.
If you do not agree with these Terms and Conditions, you should not use the relevant service.
These Terms apply generally across LBG Software's services. Additional terms may apply to a particular service where expressly provided to you.

LBG Software provides software development, software-as-a-service, business technology, automation, digital management and related technology services.
Our services may include:

Accounts
Where an account is required, you are responsible for providing accurate and current information.
You are responsible for:
- Maintaining the confidentiality of your login credentials
- Preventing unauthorised access to your account
- Ensuring information submitted through your account is accurate
- Promptly notifying us of suspected unauthorised access or security incidents
You must not knowingly provide false information or create an account for fraudulent, unlawful or abusive purposes.
LBG Software may suspend or restrict an account where reasonably necessary to protect our services, users, third parties or the integrity of our systems.

- Commit fraud or facilitate fraudulent transactions
- Attempt to gain unauthorised access to systems or accounts
- Introduce malicious software, code or other harmful material

- Circumvent security, authentication or access controls
- Abuse, harass or threaten other users
- Upload or distribute content that you do not have the right to use
- Use our services in a manner that violates applicable laws or regulations
We reserve the right to restrict or terminate access where use of our services presents a material security, legal or operational risk.
Intellectual Property
Unless otherwise agreed in writing, LBG Software retains all rights, title and interest in its software, source code, interfaces, designs, branding, systems, processes, documentation and other proprietary materials.
Your use of our services does not transfer ownership of our intellectual property to you.
You retain ownership of content and information that you lawfully submit to our services, subject to the rights necessary for us to provide the relevant service.
Third-Party Services
Our services may integrate with or depend on third-party providers, including payment processors, hosting providers, communication services, authentication providers, analytics providers and other technology providers.
Third-party services may have their own terms, privacy policies and availability requirements.
LBG Software is not responsible for independent failures, changes or policies of third-party providers beyond our reasonable control.
Payments
Where payment is required, applicable prices and payment terms will be presented before payment is requested.
Payments may be processed through third-party payment providers, including Paystack.
LBG Software does not ordinarily receive or store customers' complete card details. Payment information may be processed directly by the relevant payment service provider in accordance with its own security and privacy practices.
A payment may be subject to verification, authorisation, fraud screening or other checks by the payment provider or relevant financial institution.
Customer Support
LBG Software is responsible for customer support relating to its products and services, including receipts, service delivery, returns, cancellations, refunds and other business-specific queries.
Paystack may provide support for Paystack account and payment-infrastructure matters, but this does not replace LBG Software's responsibility to support its customers.

Subscriptions and Recurring Services
Where a service is provided on a subscription basis, the subscription period, applicable fee and renewal terms will be presented to the customer before or during purchase.
Where recurring billing has been expressly authorised by the customer, subscriptions may automatically renew according to the applicable service terms.
Customers may cancel future renewals in accordance with the cancellation terms applicable to the relevant service.
Cancellation of a subscription does not automatically entitle a customer to a refund for a period already paid for, except where required by law or where our applicable refund policy provides otherwise.
Availability
We aim to maintain reliable and secure services but do not guarantee uninterrupted availability. Services may occasionally be unavailable because of:
- Scheduled maintenance
- Emergency maintenance
- Infrastructure failures
- Internet or telecommunications failures
- Third-party service interruptions
- Security incidents
- Events beyond our reasonable control
We will take reasonable steps to restore affected services as soon as reasonably practicable.
Changes to Services
LBG Software may modify, improve, add or remove features from its services from time to time.
Where a material change significantly affects a paid service, we will take reasonable steps to communicate the change where appropriate.
Disclaimer
Our services are provided using reasonable care and skill.
However, to the extent permitted by law, LBG Software does not guarantee that every service will be completely uninterrupted, error-free or suitable for every particular business purpose.
Customers remain responsible for maintaining appropriate backups and exercising reasonable judgement when relying on information, reports, calculations or automated functionality provided through our services.
Limitation of Liability
To the maximum extent permitted by applicable law, LBG Software will not be liable for indirect, incidental, special or consequential losses arising from the use of our services.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.
Termination
We may suspend or terminate access to a service where:
- You materially breach these Terms
- Your use creates a significant security or legal risk
- Payment obligations remain outstanding
- The service is discontinued
- We are required to do so by law
Where reasonably practicable, we will provide notice before termination unless immediate action is necessary.
Governing Law
These Terms are governed by the laws of the Republic of South Africa.
Any dispute will be subject to the jurisdiction of the appropriate courts of South Africa, unless applicable law requires otherwise.
